Retrieval of profile pictures at Gravatar

We use the service Gravatar, of Automattic, Inc. 132 Hawthorne Street San Francisco, CA 94107, USA, within our online offer and especially in the blog.

Gravatar is a service where users can register and store profile pictures and their email addresses. If users leave posts or comments on other online presences (especially blogs) with the respective email address, their profile pictures can be displayed next to the posts or comments. For this purpose, the email address provided by users is transmitted to Gravatar in encrypted form for the purpose of checking whether a profile is stored for it. This is the sole purpose of the transmission of the email address and it is not used for other purposes, but deleted afterwards.

The use of Gravatar is based on our legitimate interests within the meaning of Art. 6 (1) (f) DSGVO, as we use Gravatar to offer post and comment authors the opportunity to personalize their posts with a profile picture.

Automattic is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000CbqcAAC&status=Active).

By displaying the images, Gravatar obtains the IP address of the user, as this is necessary for communication between a browser and an online service. More information about the collection and use of data by Gravatar can be found in the privacy policy of Automattic: https://automattic.com/privacy/.

If users do not want a user image associated with their Gravatar email address to appear in the comments, they should use an email address that is not on file with Gravatar to comment. We also note that it is also possible to use an anonymous email address or no email address at all if users do not want their email address to be sent to Gravatar. Users can completely prevent the transmission of data by not using our commenting system.

Akismet anti-spam check

Our online offer uses the service "Akismet", which is offered by Automattic, Inc. 132 Hawthorne Street San Francisco, CA 94107, USA. The use is based on our legitimate interests within the meaning of Art. 6 (1) f) DSGVO. With the help of this service, comments from real people are distinguished from spam comments. For this purpose, all comment details are sent to a server in the USA, where they are analysed and stored for four days for comparison purposes. If a comment has been classified as spam, the data is stored beyond this time. This information includes the name entered, the email address, the IP address, the comment content, the referrer, information on the browser used as well as the computer system and the time of the entry.

Automattic is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000CbqcAAC&status=Active).

More information on the collection and use of data by Akismet can be found in the privacy policy of Automattic: https://automattic.com/privacy/.

Users are welcome to use pseudonyms, or to refrain from entering their name or email address. You can prevent the transmission of data completely by not using our commenting system. That would be a shame, but unfortunately we don't see any other alternatives that work just as effectively.

Collection of access data and log file

  • We collect on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. DSGVO data about each access to the server on which this service is located (so-called server log files). Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC ("Google"), on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offering within the meaning of Art. 6 para. 1 lit. f. GDPR) Google Analytics, a web analytics service provided by Google LLC ("Google"). Google uses cookies. The information generated by the cookie about the use of the online offer by the users is usually transmitted to a Google server in the USA and stored there.

  • Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
  • Google will use this information on our behalf to evaluate the use of our online offer by the users, to compile reports on the activities within this online offer and to provide us with further services related to the use of this online offer and the internet. In doing so, pseudonymous user profiles of the users can be created from the processed data.
  • We use Google Analytics to display the ads placed through within advertising services of Google and its partners only to those users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited), which we transmit to Google (so-called "Remarketing Audiences", or "Google Analytics Audiences"). With the help of Remarketing Audiences, we also want to ensure that our advertisements correspond to the potential interest of the users and do not have a harassing effect.
  • We only use Google Analytics with IP anonymisation activated. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.
  • The IP address transmitted by the user's browser will not be merged with other data from Google. Users can prevent the storage of cookies by setting their browser software accordingly; users can also prevent the collection of the data generated by the cookie and related to their use of the online offer to Google as well as the processing of this data by Google by downloading and installing the browser plugin available at the following link:https://tools.google.com/dlpage/gaoptout?hl=de.
  • For more information about Google's data use, settings and opt-out options, please visit Google's websites at: https://www.google.com/intl/de/policies/privacy/partners ("How Google uses data when you use our partners' websites or apps"), https://policies.google.com/technologies/ads ("How Google uses data for advertising purposes"), https://adssettings.google.com/authenticated ("How Google manages the information it uses to serve ads to you").

Google Re/Marketing Services

We use the marketing and remarketing services (in short "Google Marketing Services") of Google LLC, 1600 Amphitheatre Park Park, Mountain View, CA 9.0. GDPR) the marketing and remarketing services (in short "Google Marketing Services") of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google").

  • Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
  • Google's marketing services allow us to display advertisements for and on our website in a more targeted manner in order to present users only with ads that potentially match their interests. If, for example, a user is shown ads for products in which he or she was interested on other websites, this is referred to as "remarketing". For these purposes, when our website and other websites on which Google marketing services are active are called up, a code is executed directly by Google and so-called (re)marketing tags (invisible graphics or code, also known as "web beacons") are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user's device (comparable technologies can also be used instead of cookies). Cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. This file records which websites the user has visited, which content he is interested in and which offers he has clicked on, as well as technical information on the browser and operating system, referring websites, time of visit and other information on the use of the online offer. The IP address of the user is also recorded, whereby we inform Google Analytics that the IP address is shortened within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and only in exceptional cases is transferred in full to a Google server in the USA and shortened there. The IP address will not be merged with data of the user within other offers of Google. The aforementioned information may also be combined by Google with such information from other sources. If the user subsequently visits other websites, he can be shown ads tailored to his interests.
  • User data is processed pseudonymously within the scope of Google marketing services. I.e. Google does not store and process e.g. the name or email address of the users, but processes the relevant data cookie-related within pseudonymous user profiles. I.e. from Google's perspective, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymisation. The information collected by Google marketing services about users is transmitted to Google and stored on Google's servers in the USA.
  • The Google marketing services we use include the online advertising program "Google AdWords". In the case of Google AdWords, each AdWords customer receives a different "conversion cookie". Cookies can therefore not be tracked through the websites of AdWords customers. The information obtained with the help of the cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. The AdWords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive information that personally identifies users.
  • We may include third party advertisements based on the Google marketing service "AdSense". AdSense uses cookies to enable Google and its partner websites to serve ads based on users' visits to this website or other websites on the Internet.
  • Furthermore, we may use the "Google Tag Manager" to integrate and manage Google analytics and marketing services on our website.
  • For more information on Google's use of data for marketing purposes, please visit the overview page:https://policies.google.com/technologies/ads, Google's privacy policy is available at https://policies.google.com/privacy
    .
  • If you wish to object to interest-based advertising by Google marketing services, you can use the settings and opt-out options provided by Google:https://adssettings.google.com/authenticated.

  • Facebook is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

The content of the plugin is transmitted by Facebook directly to the user's device and integrated into the online offer by the latter. In the process, user profiles can be created from the processed data. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and therefore inform users according to our level of knowledge.

Furthermore, according to its own information, MailChimp may use this data to optimise or improve its own services, e.g. for the technical optimisation of the dispatch and the presentation of the newsletters or for economic purposes in order to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or to pass them on to third parties.
We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement "Privacy Shield" and thus undertakes to comply with EU data protection regulations. Furthermore, we have concluded a "Data Processing Agreement" with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. You can view MailChimp's privacy policy here.
  • Registration data: To sign up for the newsletter, it is sufficient to provide your email address. Optionally, we ask you to enter your first and last name. This information is only used to personalize the newsletter. Furthermore, in individual cases we also ask you to optionally enter your date of birth, gender and industry. We only use this information to adapt the contents of the newsletter to the interests of our readers.
  • Statistical collection and analyses: The newsletters contain a so-called "web beacon", i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. Within the scope of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and the time of the retrieval are initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.
Statistical surveys also include determining whether newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our nor MailChimp's intention to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
  • Online retrieval and data management: There are cases where we direct newsletter recipients to MailChimp's websites. E.g. our newsletters contain a link with which the newsletter recipients can call up the newsletters online (e.g. in case of display problems in the email program). Furthermore, newsletter recipients can subsequently correct their data, such as the email address. Likewise, the privacy policy of MailChimp is only available on their site.
In this context, we point out that cookies are used on the websites of MailChimp and thus personal data is processed by MailChimp, their partners and service providers used (e.g. Google Analytics). We have no influence on this data collection. For more information, please refer to the privacy policy of MailChimp. We would also like to draw your attention to the options for objecting to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European region).
  • Cancellation/revocation: You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. You will find a link to cancel the newsletter at the end of each newsletter. After cancellation, your data will be deleted except for the e-mail address. The e-mail address is stored in a blacklist and is only used to ensure that we do not send any further e-mails to your e-mail address.
  • Legal basis Data Protection Regulation: In accordance with the requirements of the Data Protection Regulation (DSGVO) in force since 25 May 2018, we inform you that the consent to the sending of email addresses is based on Art. 6 1 lit. a, 7 DSGVO and § 7 para. 2 No. 3, or para. 3 UWG. The use of the dispatch service provider MailChimp, the performance of statistical surveys and analyses as well as the logging of the registration process are carried out on the basis of our legitimate interests in accordance with Art. 6 Para. 1 lit. f DSGVO. Our interest is directed towards the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of users.

We would also like to point out that you can object to the future processing of your personal data in accordance with the legal requirements pursuant to Art. 21 DSGVO at any time. The objection can be made in particular against the processing for purposes of direct advertising.

Integration of services and contents of third parties

Within our online offer, we use content or service offers of third-party providers on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO) to integrate content or services offered by third-party providers, such as videos or fonts (hereinafter uniformly referred to as "content"). This always requires that the third-party providers of this content are aware of the IP address of the user, as without the IP address they would not be able to send the content to their browser. The IP address is therefore necessary for the display of this content. We endeavour to only use content whose respective providers only use the IP address to deliver the content. Third-party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer, as well as be linked to such information from other sources.

  • The following presentation provides an overview of third-party providers and their content, together with links to their data protection declarations, which contain further information on the processing of data and, in part already mentioned here, options for objection (so-called opt-out):
  • If our customers use the payment services of third parties (e.g. PayPal or Sofortüberweisung), the terms and conditions and the privacy policy of the respective third party providers apply, which are available within the respective websites or transaction applications.

We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Google+. Privacy policy: https://policies.google.com/privacy, Opt-Out: https://adssettings.google.com/authenticated.

  • When you access our podcast episodes on our website or via podcast playback options such as iTunes and Spotify, Rawvoice initially collects technical information such as information about the browser and your system, as well as your IP address and the time of access.
